There are two types of LPAs:
Health and Welfare LPA

It ensures that your personal welfare and healthcare are taken care of according to your preferences.
Property and Financial Affairs LPA
This empowers your attorney to handle your financial matters, including managing bank accounts, paying bills, collecting pensions or benefits, and selling your home if necessary. This can be used once registered.
It can help you manage your money and property more easily. It requires your permission. It is different from the Health and Welfare LPA.
Creating a Lasting Power of Attorney

The final step is registering your LPA with the Office of the Public Guardian, which incurs a fee of £82, subject to reductions or exemptions based on your financial situation. Registration is crucial as it activates the LPA, making it a legally binding document.
You can cancel or change your LPA if things change or if you want to change your chosen attorneys. This will ensure that your LPA always reflects your preferences and the current situation. This adaptability underscores the LPA’s role as a dynamic tool for future planning.
Frequently asked questions about getting a Will
Can I have more than one attorney?
Yes, you can appoint multiple attorneys to act on your behalf for both health and welfare and property and financial affairs.
When can my attorney start making decisions for me?
For health and welfare, your attorney can only make decisions if you lack the capacity to do so yourself. For property and financial affairs, your attorney can start making decisions as soon as the LPA is registered, with your permission.
What if I change my mind after creating an LPA?
You can cancel your LPA at any time if you have the mental capacity to do so, whether you want to appoint different attorneys or you no longer need the LPA.
How long does it take to register an LPA?
Registration with the Office of the Public Guardian can take up to 20 weeks. It’s advisable to start the process as early as possible.
Do I need to live in the UK or be a British citizen to make an LPA?
No, you do not need to be a UK resident or a British citizen to create an LPA.
